Terms and Conditions – TravelwithMkay

Welcome to TravelwithMkay. These Terms and Conditions govern your use of our website travelwithmkay.co.ke and any services, products, content, coaching or resources we provide (together, the “Services”).
By accessing our website, booking a call, purchasing a product, or using any of our Services, you agree to be bound by these Terms and our other policies, including our Privacy Policy and Refund & Cancellation Policy. If you do not agree, please do not use our Services.
Important: TravelwithMkay is a travel coaching and educational service. We are not a travel agency or tour operator. You remain responsible for your own bookings, visas, safety and travel decisions.
1. Who we are
TravelwithMkay is a travel coaching brand operated by:

We support primarily African women 40+ worldwide in planning confident, sustainable travel through coaching, calls, workshops and digital resources delivered online.
2. Eligibility & use of the site
By using our website or Services, you confirm that:
- You are at least 18 years old, or the age of majority in your country; and
- You have the legal capacity to enter into a binding contract; and
- You will use our Services lawfully and in line with these Terms.
We may refuse access to our Services at our discretion, for example in cases of abuse, harassment, or non-payment.
3. Our services (coaching, calls, digital products)
We currently offer, among other things:
- Paid 1:1 coaching calls (e.g., confidence calls, itinerary reviews);
- Online coaching programmes, workshops or group sessions;
- Digital resources such as guides, templates, checklists and other educational material;
- General information and travel inspiration via our website, blog and social media.
Details, pricing and scope of each service are described on the relevant page or sales page at the time of booking. We may update or discontinue Services at any time.
4. Booking, payments & scheduling
1. Booking process
Coaching calls are usually booked by first completing payment through our payment provider (e.g. Pesapal – including M-Pesa / card – or other gateways we may add), and then scheduling a time via our calendar tool (e.g. Calendly). Your booking is only confirmed once both payment and scheduling are complete.
2. Payments
All payments are processed securely by third-party payment processors. We do not store your full payment card details. You are responsible for any bank, currency conversion or transaction charges that may apply in your country.
3. Prices & currency
Prices are indicated in the currency stated on the sales or booking page at the time of purchase. We may change prices at any time; however, the price confirmed at checkout will apply to your purchase.
4. Cancellations & refunds
Cancellations, rescheduling and refunds for coaching calls, programmes and digital products are governed by our Refund & Cancellation Policy, which forms part of these Terms. By purchasing or booking with us, you acknowledge that you have read and agree to that policy.
5. No chargebacks in place of communication
If you experience any issue with a product or service, you agree to contact us first to attempt a resolution before initiating any chargeback with your bank or payment provider.
5. Coaching relationship & disclaimer (we are not a travel agency)
1. Coaching, not agent services
TravelwithMkay provides coaching, education and guidance to help you plan and experience travel more confidently. We do not act as a travel agent, tour operator, airline, hotel, insurance provider, visa consultant or any other regulated travel intermediary.
2 .You make your own travel decisions
All decisions regarding destinations, routes, bookings, timing, budgets, visas, vaccinations, travel companions and activities are entirely your responsibility. Any suggestions or examples shared during coaching are for guidance and inspiration only and do not constitute professional legal, medical, financial or security advice.
3. Third-party bookings & services
You may choose to book flights, accommodation, tours, insurance or other services with third-party providers we mention or link to. These third parties are solely responsible for their own products and services. We are not a party to your contract with them and are not liable for any act, omission, delay, cancellation, overbooking, injury, loss or damage caused by them.
6. Travel risk, safety & your responsibilities
Travel inherently involves some level of risk, including but not limited to:
- Accidents, injuries, illness or medical emergencies;
- Theft, loss or damage to luggage or personal property;
- Political instability, natural disasters, strikes or other disruptions;
- Visa refusal, immigration issues, or denied boarding;
- Changes to local laws, customs or requirements.
By using our Services, you agree that:
- You are responsible for checking and complying with all relevant visa, passport, vaccination, insurance and entry requirements for your destination(s);
- You will obtain adequate travel insurance (including medical, trip cancellation, baggage protection, and any other relevant coverage) that is suitable for your specific travel plans;
- You travel at your own risk and understand that TravelwithMkay cannot guarantee your safety or circumstances during travel.
To the fullest extent permitted by law, we are not liable for any personal injury, illness, death, loss, damage, expense or inconvenience arising from your travel, except where directly caused by our gross negligence or intentional misconduct.
7. Client conduct & expectations
During coaching calls or programmes, you agree to:
- Show up on time and come prepared with any required materials or completed tasks;
- Communicate with respect and honesty throughout all interactions;
- Complete any agreed tasks between sessions.
- Avoid abusive, discriminatory or harassing behaviour towards us or other participants.
We reserve the right to terminate a session or refuse future services if behaviour is inappropriate, harmful or breaches these Terms. In such cases, refunds may not be granted.
8. Rescheduling & no-shows
Specific timing and conditions for rescheduling or missed appointments are detailed in our Refund & Cancellation Policy. In general:
- You may be allowed to reschedule with a minimum notice period (e.g. 24–48 hours), subject to availability.
- If you arrive late, we may still end the session at the originally scheduled time out of respect for other clients.
- No-shows or late cancellations may be charged as a full session, and no refunds or credits will be issued in such cases.

9. Digital products, access & intellectual property
1. Licence to use
When you purchase a digital product (e.g. PDF guide, checklist, workbook), you receive a personal, non-exclusive, non-transferable licence to use it for your own private, non-commercial purposes. You may not share, resell, upload, distribute or reproduce our materials for others without written permission.
2. Content ownership
All content on our website and within our Services – including text, logos, images, graphics, videos, audio, PDFs, and branding – is owned by TravelwithMkay or used under licence. Unauthorised copying, distribution, modification or public display of our materials may violate copyright or other laws.
10. Testimonials & success stories
We may share client stories, testimonials or case studies on our site and social media.
- These represent individual experiences and outcomes, which may not be typical for all users.
- Your results will depend on your own effort, decisions, resources and circumstances.
- We do not guarantee any specific travel, lifestyle or financial outcomes from using our Services.
If you provide a testimonial, you grant us permission to use your words (and, if agreed, your first name and/or photo) for marketing in line with our Privacy Policy. You can request removal in future by contacting us.
11. Affiliate links & recommendations
Sometimes we may recommend or link to tools, apps, services or products (e.g. eSIMs, luggage, booking sites). Some of these links may be affiliate links, meaning we may earn a small commission if you purchase through them, at no extra cost to you.
We only share recommendations we believe may be genuinely useful, but we do not control these third-party sites or offers. You are responsible for reviewing their terms, conditions and privacy policies before purchasing.
12. Privacy & data protection
We collect and process personal data in accordance with our Privacy Policy, which explains:
- What information we collect (e.g. name, email, booking details);
- How and why we use it (e.g., to deliver services or send confirmations);
- How we store and protect your data in a safe and secure manner;
- Your rights under applicable data protection laws.
By using our Services, you acknowledge that you have read and agree to our Privacy Policy.
13. Website availability & changes
We aim to keep our website and Services available and accurate, but:
- We do not guarantee that access to our Services will always be uninterrupted, error-free, secure, or up-to-date at all times.
- We may modify, suspend or discontinue any part of our site or Services at any time, with or without notice.
- We are not liable for any loss resulting from temporary unavailability or technical issues beyond our reasonable control.
14. Limitation of liability
To the fullest extent permitted by law:
- Our total liability to you for any claim arising out of or in connection with these Terms, our website or Services shall be limited to the amount you actually paid us for the relevant service or product.
- We are not liable for any indirect, incidental, special or consequential damages, including loss of profits, opportunities, or data, arising from your use of or inability to use our Services.
Nothing in these Terms excludes liability for death or personal injury resulting from our gross negligence, or any other liability that cannot be excluded under applicable law.
15. Indemnity
You agree to indemnify and hold harmless TravelwithMkay and its owner(s), team members and partners from any claims, losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of:
- Your breach of these Terms;
- Your misuse of our website or Services;
- Your travel decisions, actions or omissions;
- Your breach of law or third-party rights.
16. Changes to these Terms
We may update these Terms from time to time to reflect changes in our Services, laws or business practices.
- The “Last updated” date at the top will show when changes were made.
- Your continued use means you accept the updated Terms.

17. Governing law & disputes
These Terms are governed by the laws of the Republic of Kenya, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms, our website or Services shall be subject to the exclusive jurisdiction of the courts of Kenya, unless mandatory law in your country requires otherwise.
